Terms and Conditions

1. Introduction

Upon purchasing, these Terms and Conditions ("Terms") govern your use of the Aria Breath App and the services provided through it. By purchasing, downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not purchase or use the App.

2. License to Use

Aria Breath grants you a non-exclusive, non-transferable, revocable license to use the App and its content for your personal, non-commercial use, subject to the limitations set forth in these Terms.

3. Personal Use Only

You acknowledge that the App and its content, including all music and guided breathwork sessions, are provided for personal use only. You agree not to use the App or any content provided through it for any commercial, professional, or public purposes without obtaining additional training and certification from Aria Breath.

4. Prohibited Use

You are expressly prohibited from: a. Using the App or its content in any public or professional setting, including but not limited to fitness centers, wellness clinics, public events, or within professional services, without undergoing further training and obtaining explicit permission from Aria Breath. b. Copying, redistributing, reproducing, or transmitting any content provided through the App in any form or by any means without the prior written consent of Aria Breath. c. Modifying, altering, or creating derivative works based on the App or its content.

5. Health and Safety

You understand that breathwork and any guided exercises provided through the App can have significant physical and mental effects. You agree to use the App responsibly and at your own risk, acknowledging the need to consult a healthcare professional before beginning any new wellness program, especially if you have pre-existing health conditions.

6. Liability

You agree that Aria Breath, its affiliates, and its licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from your use of the App or inability to use the App.

7. Music Licensing and Rights

You acknowledge that the music and content provided through the App are subject to complex music licensing agreements and intellectual property rights. Aria Breath is committed to respecting these rights and the rights of musicians, animators and existing licensees (Aria Breath teachers), including trained and certified teachers who use the App's content professionally. Aria Breath actively protects it’s intellectual property rights and the unique offering of it’s teachers. Unauthorized use of the App's content in a professional or public capacity may expose you to liability and severe legal action.

8. Amendments to Terms

Aria Breath reserves the right to amend these Terms at any time. You will be notified of any changes through the App or via email. Your continued use of the App after such changes constitutes your agreement to the new Terms.

9. Termination

Aria Breath reserves the right to terminate your access to the App without notice if you are found to be in violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Aria Breath operates, without giving effect to any principles of conflicts of law.
